SAUGERTIES — An Ulster County man was arrested on felony charges following a domestic dispute in which he is accused of destroying personal property of the victim, Saugerties Police Chief Joseph Sinagra said.

Robert R. Amirault, 45, of Saugerties, is accused of flushing the victim’s dentures down a toilet and breaking a pair of glasses, Sinagra said.

Police did not disclose any information about the victim, including their relationship with Amirault.

On Thursday, at about 5:01 a.m., police responded to an apartment on Partition Street after receiving a 911 call about a reported domestic dispute.

Police took Amirault into custody, where he was charged with third-degree criminal mischief, a class E felony, and fourth-degree criminal mischief, a class A misdemeanor, Sinagra said.

Amirault was arraigned in Village of Saugerties Justice Court and released on his own recognizance, Sinagra said. Amirault is scheduled to reappear in court at a later date.

A no-contact order of protection was issued by the court on behalf of the victim.

According to New York Penal Law, a person may be charged with third-degree criminal mischief when, with intent to damage property of another person, and having no right to do so nor any reasonable ground to believe that he or she has such right, he or she damages property of another person in an amount exceeding $250.

The same charged could be levied, if the defendant had broken into a motor vehicle.

If convicted on this charge, the sentence may include up to 4 years in prison, probation up to 5 years, a fine and payment of restitution.

New York Penal Law defines fourth-degree criminal mischief as recklessly damaging property of another person in an amount exceeding two hundred fifty dollars.

If convicted, the sentence may include up to one year in jail, probation and a fine.
