PHILMONT — Five men from three area counties including two from the Capital Region were arrested on felony weapons possession charges over the weekend in Columbia County, state police said.
The arrests followed a traffic stop on Saturday morning in the village of Philmont, said Aaron Hicks, public information officer for state police Troop K.
The five men were identified by police as: Lawrence M. Osborn, 30, of Philmont; Jacob F. Muniz, 21, of Albany; Adijonay J. White, 19, of Troy; Joshua D. Carey, 24, of Glenmont; and Isaiah S. Allen, 19, of Troy, Hicks said.
At about 11:36 a.m., troopers stopped a car that was being driven by Carey on Lower Ark Street for a possible traffic infraction, Hicks said.
While investigating, police discovered a Smith and Wesson M&P 40 semi-automatic pistol in the vehicle. Troopers also found that Carey was in possession of a quantity of cocaine, Hicks said.
All five men were charged with second-degree criminal possession of a weapon, a class C felony. Cary was also charged with seventh-degree criminal possession of a controlled substance, a class A misdemeanor, Hicks said.
All five were processed and later arraigned in Village of Philmont Court. Osborn and Allen were sent to the Columbia County Jail and held without bail. Muniz, White and Carey were released on their own recognizance pending their next court appearance.
New York Penal Law defines second-degree criminal possession of a weapon as: with intent to use the same unlawfully against another, such person possesses a loaded firearm.
Second-degree criminal possession of a weapon is a class C felony.
If convicted of this charge in a court of law, the sentence may range from a minimum of 3 1/2 years to a maximum of 15 years in prison.
In addition, the defendant may be required to pay a fine and will be required to pay mandatory court fees.
