PITTSFIELD — A Hudson man is accused of raping and assaulting a toddler, police said.

Gary Montana, 32, of Hudson, was arrested by New York State Police Aug. 21 on a warrant by Pittsfield, Massachusetts, police for the alleged rape and assault of an 18-month-old boy, according to a statement from state police.

Montana was wanted for indecent assault and battery on a child under 14 and rape of a child with force, all felonies under Massachusetts state law, according to state police.

Montana was ordered to be extradited as a fugitive from justice after his arraignment in Greenport Town Court. He was in Columbia County Court as of Thursday, said Fred Lantz, a spokesman for the Berkshire County District Attorney’s Office.

Erica Emerling, 29, of Pittsfield, was also charged in connection with the incident. Pittsfield police charged Emerling with aggravated indecent assault and battery on a child under 14 and posing a child in a sexual act, according to police.

Emerling pleaded not guilty to the charges Monday.
